"How...? What do you mean how?!" Eggman slammed his desk with his hand. "Tell us what business Omega had at my base!"

"Then you should have been more specific. If you want to know exactly what Omega wanted, you'd have to ask him, but I believe that he wanted to facilitate communications and terminate hostilities."

"Is that so? Elaborate. What kind of communications did he wish to facilitate, and how did he plan to terminate hostilities?" Eggman sneered. "To the best of your knowledge, of course."

"You would be the obvious one he wanted to talk to, though his means of 'terminating hostilities' was fairly obvious judging from what happened."

"Ah, if I may interject, Mr. Eggman... I have to note, that during the time I've been sitting here listening to you, it is almost as if you are trying to -force- some sort of incriminating testimony out of Mr. Jonas here... In fact, from the way things have gone, I would say that this Shadow and Omega are the ones we should be questioning, not the fellow on the stand right now!"

And Eggman held the bridge of his nose between his fingers. "I think I'm getting a migraine." Eggman looked up again. "Your Honor. For about the third time now... We are trying to establish whether or not Jonas Lans CONSPIRED to commit murder. Not whether he had planned to be the one to deliver the killing blow. And his testimony is very telling up to this point. Let's assemble the facts, shall we?" Eggman slammed his hand on his desk. "First! Jonas Lans has stated in this courtroom that he planned to help his friend, E-123 Omega! Second! Jonas Lans has stated that his suspicion of Omega's intent was a 'termination of hostilities'! And third..." In a dramatic motion, Eggman pointed at the defendant. "Jonas Lans has stated that the manner in which hostilities would be terminated was obvious! In short... The defendant, with knowledge of what Omega had planned, conspired to help him!"

"Mr. Lans has testified that he only gained knowledge of Omega's M.O. AFTER they had arrived! You cannot claim he was conspiring to assist Omega in his methods when he was completely unaware of them until they were already on the premesis!! Jonas Lans only discovered Omega's intended behavior because Omega abruptly began acting without any communication to or from the defendent!!"

" I would call stealing one of our mechs and attacking us with it conspiracy," Metal muttered to himself in a barely audible voice.

The judge shook his head, and peered down at the Prosecution's bench. "The defense has a point. If you had asked me to accompany yourself to the mall, and upon reaching the location, you began throwing bricks through display windows, and stealing anything you wanted, I most certainly wouldn't have been able to help 'conspire' you to do anything. Such abrupt behavior on your part would have been impossible to predict, and furthermore, impossible for me to aid on part as a fellow conspirator! All I would have done was come along for the ride without knowledge of malicious intent. On this particular testimony, I am afraid I must rule in favor of the defense."

Eggman raised his index finger and shook it, smirking to himself. "Not so fast, Your Honor. In fact, I have undeniable proof that the defendant had malicious intent... and indeed, acted upon it! But first... I'm sure that you wish to get in your own words." Eggman looked up, his smirk not fading. "Isn't that right, Wright?"

The phoenix's expression was unamused. If Eggman had such "undeniable proof", why'd he even bother calling his client to the stand? "I'd like to cross-examine, yes, if that's what you're asking."

The judge shook his gleaming head, as if to deprive himself of all of the vapors from within his mind. This court case was beginning to give him a headache. "Well, if the Prosecution is done with their questioning, then the Cross-Examination shall commence."

((Judge snip written by Tony.)) The phoenix adjusted his tie. He'd prepared a few questions in advance, of course, but there was something niggling at him... Like there was something important that should've been right in front of his face. I don't think I can even USE most of my questions at this point, Wright realized, carefully rubbing his beak with one feathered hand. I'd mostly be asking the same questions Eggman already did, and Jonas already gave him the same answers he'd give me. Perhaps it would've been wiser to pass on the cross-examination, but... it just wouldn't have felt right. It'd be like giving up or admitting that Eggman was running the show. ...What WAS that tickling the back of his mind?? "Um... Mr. Wright? You look... distant. ... Do you want to continue with the Cross Examination, or shall I end this testimony period?" "Huh?" The phoenix blinked and glanced up at the judge. It was now or never. "No, Your Honor, I'd like to cross-examine. Sorry for the delay." Clearing his throat, the attorney turned to his client and said, "Mr. Lans, had you ever met Mr. Eggman, or had any dealings with him, prior to the incident in question?"

The attorney paused. His line of questioning didn't really seem bad... But at the same time, it didn't seem to be as hard-hitting as he would've liked. The testimony was basically a paraphrase of, "I didn't do it." The odds were already in his favor of getting Jonas off the hook, but it felt like something was missing. And there was STILL that odd sense of having missed something in the back of his mind. Something important. Something obvious. Wright's feathers fluffed slightly as he struggled to solve the conundrum. I prepared for every INCH of this case! How could there be something I missed in the court record?!Then it suddenly occurred to him: perhaps it wasn't something in the current record. Maybe he needed to think outside of the box for a moment. Maybe he needed to turn toward evidence that was a little more... recent. Wright's beak spread into a wide grin. Don't ask me how that was possible. GOTCHA."Mr. Lans, did you and Mr. Eggman have a conversation earlier today, just before we entered the courtroom?"

"Would you mind telling the court what, exactly, Mr. Eggman said to you?" Internally the phoenix smirked. Eggy's going to regret pushing to let hearsay evidence in.

"Well...he started by saying he felt sorry for me, because if it hadn't been for, I quote: 'that ungrateful, deranged and murderous piece of scrap', that he doubted I would have ended up at his base, and that I'd have to take responsibility for my actions wether it was Omega's influence or not," He said, "Then Metal Sonic noticed May, and there was a brief argument about her design before the press showed up..."

"So sorry to intrude, Mr. Wright... But a pre-schooler could see where this is headed. Let me ask you something. You should be well-versed in the law, I assume... Suppose a friend invited you to a party, and you had knowledge that the party was being held on someone else's private property... Suppose the owner of said property decided to file charges of trespassing. Would the law care whether or not you would have been there if your friend had not invited you? And more relevant... Suppose you and a friend went to the mall, and your friend ended up commiting a theft. You did not notify the police, and in fact, you gave your friend a ride. There is a word for someone like this. Do you perhaps know what it is?"

"You keep throwing a very important word around: knowledge. In order to be an accomplice to a crime, you have to have knowledge of what's about to be done. That's where your analogies fail, Eggman. In accompanying the friend, it's not enough to know it's private property; you have to have knowledge that your friend does not have clearance to be there. In the case with the mall, if you're unaware of your friend's criminal intent, then you have no reason to call the authorities or refuse to assist! The law does not convict people for simply having fallen into an unfortunate circumstance!" Wright paused and slammed his hands on the defense desk, with what appeared to be smoke beginning to curl around his body. "Omega is YOUR robot, Eggman! What reason would Mr. Lans have to think that your OWN creation would be restricted from your property?! We've also already established that Omega -- whom you yourself admit was the 'murderous' party -- had no communication with my client of his intentions!" The phoenix's eyes intensified, and despite his efforts, a few small flames began igniting from the feathers around the cuffs of his sleeves and the back of his head. "Did you, or did you not, admit yourself just outside of this very courtroom that my client would likely have NEVER been in your base had it not been for YOUR own 'murderous' machine?! This entire lawsuit is simply out of spite, and nothing more!! You're only sueing my client because to sue Omega would mean you'd be sueing yourself!!"

"Order! ORDER!!" "Defense! Prosecution! Just what is the meaning of this?! I demand to know just what you're driving at, first and foremost, Mr. Wright! It seems as though as... You're trying to accuse the Prosecution of... attempting to convict an innocent man for something that -he- was the sole responsibility of..!"

"I'm not suggesting anything," Wright replied grimly, continuing to glare at Eggman. "The evidence speaks for itself!" Then, noting the stray flames, the phoenix distractedly patted them out.

"... Hm. I do have to admit... The defense has a point. From what the Court gathers... Mr. Eggman was the creator of the machine... The very one who intruded upon his base with malicious intent. Of course, the witness, and the defense, claims that Jonas followed the robot without any notion of concern, seeing as, usually, an Eggman Creation would have permission to see to the grounds of the Prosecutor's private property. Seeing as how this appears to be confirmed..." "... This would imply that the guilty party here is not Jonas, but rather, Mr. Eggman, for allowing something he was resposible for... to lay waste to his -own- base."

"Ridiculous. One look at that machine and you can tell it has it out for me! He constantly rants about needing to exterminate me and my creations! Omega defected from the Eggman Empire. How can I be responsible for this machine's doings, Your Honor..." Eggman pointed directly at the judge to emphasize his point. "Than you could if a bailiff attempted to steal your gavel and conk you in the head?!"

Post by Leedzie on Mar 2, 2008 1:27:52 GMT -5
"Are you KIDDING, Eggman?! The bailiff is a living, independent person. Omega is property -- YOUR property! You built it, you put it together, you wrote the programming, and you set it loose! You have no one to blame in this situation but yourself!! You're just as responsible for that robot as a dog-owner would be if their rottweiler got loose and mauled an innocent by-stander!!" Throughout the rebuke, smoke had once again started drifting skyward from the smouldering phoenix's body. Just then there was a huge commotion as the rottweiler community rose up as one and called Wright a specieist.

There was a sudden angry and mechanical sounding growl. Metal's eyes had brightened into a furious glow and his talons clenched together tightly at his sides. It was clear he was trying extremely hard to restrain himself. "I find that statement to be highly offensive." he spoke in a way that sounded as though it had been forced through gritted teeth.
